On May 16, 2008, Aarushi Talwar, a 14-year-old Class IX student of Delhi Public School in Noida and the daughter of a successful dentist couple, was found dead with her throat slit in her parents' home at Jalvayu Vihar in [Noida, Uttar Pradesh].

Suspicion initially fell on the family's live-in manservant Hemraj, who was missing. Noida police declared him the prime suspect. However the following day, following a trail of blood, in the Talwar's home, police found the dead body of Hemraj on the terrace.

After a disorganized investigation, the police arrested Dr. Rajesh Talwar, the father of the deceased girl on May 23, 2008, charging him with having committed the double murder. He confessed to killing Aarushi and Hemraj to the Police on the night of his arrest but later retracted his confession.

His wife, Dr. Nupur Talwar (Arushi Talwar’s mother, who runs a dental clinic), accused the Noida police of framing him, and requested Uttar Pradesh chief minister Mayawati to transfer the case to the Central Bureau of Investigation (CBI).This was done at the behest of the media attention on the case. Furthermore there were reports of the case being handed over to the CBI.

The Central Bureau of Investigation took over the investigation into the murders of Aarushi and Hemraj on June 1, 2008, forming a 25-member team in an attempt to crack the case. Soon after the CBI took over the case, Uttar Pradesh chief minister Mayawati gave transfer orders to senior police officers who were part of the Special Investigation Team (SIT) that had previously been in charge of the investigation, including the Noida Senior Superintendent of Police, Satish Ganesh, and Meerut Inspector General, Gurdarshan Singh. and family In addition, the deputation of CBI officer Arun Kumar, formerly a member of the Uttar Pradesh Police, who was in charge of the investigation also ended in July, 2008.

The case received nationwide attention, and has become symptomatic of what most people believe are recent unsavoury tendencies in the Indian media, such as sensationalism, the urge to "overkill" and to carry out a public trial-by-media.

The Union Minister for Women and Child Development, Renuka Chowdhury, condemned the police for what she called the "character assassination" of a child victim and called for a commission of legal experts to investigate whether specific legislation existed or needed to pass in order to allow filing of defamation suits against the Noida police, a government agency.

In addition, the focus by 24-hour cable news on speculative aspects of the personal lives of the father and his dead daughter, and the media frenzy that compromised the privacy of the families involved in the case has caused comparisons to be made to the JonBenet Ramsey case in the United States.

The case has also attracted a lot of public attention as a bizarre whodunit, with the CBI reporting that the agency had been receiving a large number of telephone calls from members of the general public, giving investigators ideas and advice on how to solve the case.

He was earlier subjected to polygraph test twice at Central Forensic Science Laboratory (CFSL), Delhi as well as psychological assessment test at AIIMS, New Delhi on June 9, 2008; based on the test results, CBI arrested Krishna.

A lie detector test is also conducted on Vijay Mandal, the domestic help of a neighbor of the Talwars.

Krishna produced before special magistrate, CBI court, Ghaziabad. CBI applies for further 11 days police custody remand to continue the investigation. The magistrate grants 6 days police custody. He is to be produced before the CBI magistrate, Ghaziabad on June 23, 2008.

Washed T-shirts with faint human blood stains seized and sent for DNA matching. However, the Duranis (doctors themselves) maintain that the stains could be from the boils that Rajkumar had on his body. Rajkumar had already been subjected to polygraph test, psychological assessment, brain mapping and narco analysis at FSL, Gandhinagar from June 23 to June 26, 2008.

Dr. Nupur Talwar refuses the allegations regarding their absence on the night of the murders. She also expresses her intention to take legal action against the media house.
CBI releases an official statement on their site, stating, "A section of media has reported quoting CBI sources that Dr. Rajesh Talwar and Dr. Nupur Talwar were not present in their house on the night of 15th May, 2008 and more than a dozen rooms were booked in a hotel in Delhi. It is clarified that the news item is speculative and not true. Investigation of the case is progressing diligently."
Some other TV channels debate the merits of her and CBI's affirmations in the light of glaring gaps in the Talwars' story.

News reports on some TV channels suggest that the CBI has had a breakthrough on Rajkumar as the culprit and has confessed during the narco-analysis test. He is learned to have committed the murder along with Krishna, Sambhu and Hemraj. The reason for the first murder, as told by Rajkumar, was lust and Hemraj was killed for fear that he might have disclosed information.

In a press conference, Arun Kumar, Joint Director CBI, states that the CBI is awaiting DNA matching of washed blood stains on Rajkumar's T-shirts. He confirms that the CBI still considered this a blind case and expresses the hope that the case will be solved soon.
Dr. Rajesh Talwar and Krishna appear before a special CBI court, Ghaziabad to seek bail. Their petitions are heard and Dr. Rajesh Talwar is released on bail, for lack of evidence. Eminent criminal lawyer R. K. Anand undertakes the defence of Krishna.
CBI believes two or three domestic helps and Krishna to be the prime suspects. However, the forensic evidence is not admissible as evidence in the court.
The murder weapon and the two cellphones respectively of Aarushi and Hemraj are still missing.

Dr. Rajesh Talwar is freed on bail from the Dasna Jail in Ghaziabad. The news of his release brings back widespread media attention to the case.
Vijay Mandal is sent to 3-days' CBI custody by the court of additional chief judicial magistrate Dinesh Kumar in Ghaziabad. Vijay Mandal has been accused under 302, 201, 120(B) of the Indian Penal Code (IPC).

It has weakened the case against the three prime suspects — Krishna, Rajkumar and Vijay Mandal. The CBI claims near closing of the case when preliminary reports from Hyderabad's Centre for DNA Fingerprinting and Diagnostics, suggests that identifying the blood on the T-shirt "may or may not be possible", according to media reports. Separating DNA from garments after a lapse of two months is not always possible, because of the disintegration of the red blood cells on the cloth.

Rastriya Jana Morcha (RJM) chairman Chitra Bahadur K.C. alleges that the two Nepalese nationals Krishna Thapa and Rajkumar were falsely accused by the CBI in the case, in order to save Dr. Rajesh Talwar. The party has decided to raise the issue in the Nepalese parliament. The party will also approach the Nepalese government and the national human rights commission to save the two.

A bench comprising Justice Altmas Kabir and Justice Markandey Katju of the supreme court of India instructs the media to be careful in the context of the hearing of a public interest lawsuit that has raised questions on the media coverage of the high-profile murder case. In the probe, the character of the victim's parents was hotly debated, especially that of Aarushi's father Rajesh Talwar who was arrested initially as the main accused. However, no adverse observations were made about the compounder Krishna and the other two domestic helps Rajkumar and Vijay Mandal. A distinction seems to have been made according to the accused persons' class and national identities.

The Central Forensic Laboratory in Hyderabad releases a report that Aarushi's vaginal samples were substituted with those of an unknown woman. The correct samples could have helped to establish who killed the teenager, and whether she was sexually assaulted before being stabbed. The clothes that Aarushi was found in were soaked in blood. But the forensic lab received clean clothes.

नोएडा। उत्तर प्रदेश में गौतमबुद्ध नगर जिले के नोएडा में बृहस्पतिवार रात एक घरेलू नौकर ने एक 14 वर्षीय लड़की आरुशी की हत्या कर दी।
वरिष्ठ पुलिस अधीक्षक ए सतीश गणेश बताया कि दिल्ली पब्लिक स्कूल की छात्रा आरुशी तलवार जो नोएडा के सैक्टर 25 में रहती थी, की हत्या उनके घरेलू नौकर हेमराज द्वारा कर दी गई।
गणेश ने बताया कि जब आरुशी अपने बेडरूम में सो रही थी नौकर हेमराज उसके कमरे में घुसा तथा उसने चाकू मारकर उसकी हत्या कर दी तथा मौके से फरार हो गया। उन्होंने बताया कि इस हत्या के कारणों का अभी पता नहीं चल सका है, लेकिन इसके पीछे यौन उत्पीड़न के मामले से भी इनकार नहीं किया जा सकता। उन्होंने बताया कि घर से किसी बहुमूल्य वस्तु के गायब होने की सूचना नहीं है।
उन्होंने बताया कि लड़की के पिता राजेश तलवार नोएडा के फोर्टिस अस्पताल में मशहूर दंत विशेषज्ञ हैं तथा लड़की की मां नुपुर तलवार भी डाक्टर हैं। उन्हें भी इस घटना के बारे में तड़के ही पता चला। हत्यारा नौकर हेमराज, जो मूल रूप से नेपाल का रहने वाला था, करीब आठ माह से नौकरों के लिए बने कमरों में रहता था। गणेश ने बताया कि इस संबंध में मामला दर्ज कर शव को पोस्ट मार्टम के लिए भेज दिया गया है।

आरुशी का आज जन्मदिन है, मरी कहां ज़िंदा है वह

नौ दिन पहले जो आरुषी मार दी गई, आज उसका जन्मदिन है। 24 मई, 1994 को जन्मी आरुषी आज होती तो पूरे 14 साल की हो गई होती। मां-बाप की इकलौती संतान थी। नाना-नानी की इकलौती नतिनी थी। सबकी प्यारी थी, राजदुलारी थी। लेकिन बाप ने अपनी ही राजदुलारी की हत्या कर दी। क्यों कर दी? पुलिस की थ्योरी है कि आरुषी के पिता डॉ. राजेश तलवार के अपने ही साथ काम करनेवाली डॉ. अनीता दुर्रानी से अवैध संबंध थे। आरुषी इसको लेकर अपने पिता से नाराज़ रहती है और ऐतराज़ भी जताती थी। यहां तक कि वह घर के नौकर के साथ इसको लेकर बात किया करती थी।

ध्यान दें, घर में कुल चार सदस्य थे। बाप राजेश तलवार, मां नूपुर तलवार, बेटी आरुषी और नौकर हेमराज। इनमें दो सदस्य आरुषी और हेमराज मर चुके हैं तो वे पुलिस को बता नहीं सकते कि उनके बीच क्या बातें हुआ करती थीं। और, आरुषी बाप के अवैध रिश्तों के बारे में हेमराज से की गई बात अपने मां या बाप को नहीं बता सकती थी। बाकी बचे दो लोगों में से मां नूपुर तलवार ने चुप्पी साध रखी है और बाप राजेश तलवार अपने को निर्दोष बता रहा है तो वह पुलिस को हत्या का ‘मोटिव’ नहीं बता सकता। फिर पुलिस को कैसे पता चला कि आरुषी और हेमराज आपस में राजेश तलवार के अवैध रिश्तों की बात किया करते थे?

हकीकत यह है कि राजेश तलवार, उनकी पत्नी नूपुर तलवार, अनीता दुर्रानी और उनके पति प्रफुल्ल दुर्रानी चारों के चारों दांतों के डॉक्टर हैं और कई अस्पतालों और क्लीनिक्स में एक साथ जाते थे। इनके बीच प्रोफेशनल रिश्ते हैं। अगर अनीता दुर्रानी और राजेश तलवार के बीच अवैध रिश्ते होते तो सबसे पहले इस पर नूपुर तलवार और प्रफुल्ल दुर्रानी को ऐतराज होता और उनका प्रोफेशनल रिश्ता कब का टूट चुका होता। पुलिस को भी शायद अपनी दलील के हल्का होने का अंदेशा था। तभी तो उसने अपनी थ्योरी के साथ एक सब-थ्योरी नत्थी कर दी। वो यह कि 14 साल की आरुषी और 47 साल के हेमराज के बीच जिस्मानी ताल्लुकात बन चुके थे। 15 मई को जब तलवार दंपत्ति रात करीब 11.30 बजे घर लौटे तो हेमराज और आरुषी को आपत्तिजनक हालत में देखा। इस पर बौखलाए डॉ. राजेश तलवार ने पहले हेमराज को छत पर ले जाकर मारा। फिर नीचे उतरकर ह्विस्की पी और तब आरुषी के कमरे में जाकर उसकी हत्या कर दी।

सवाल फिर उठता है कि पुलिस को इतनी ब्यौरेवार जानकारी किसने दी, खुद को झूठ-मूठ फंसाये जाने की बात कहनेवाले डॉ. राजेश तलवार ने या उनकी पत्नी नूपुर तलवार ने क्योंकि बाकी जो दो गवाह थे, वे मर चुके हैं और परिस्थितिजन्य साक्ष्यों के आंख और कान इतने खुले नहीं होते। खैर, पुलिस की थ्योरी में जो भी पेंच हों, उन्हें फिलहाल के लिए किनारे छोड़कर यकीन कर लेते हैं कि अपनी प्यारी इकलौती बेटी का कत्ल डॉ. राजेश तलवार ने ही किया है। क्यों किया – इस सवाल का उत्तर भी शुरू से बड़ा साफ है। लेकिन न जाने क्यों पुलिस से लेकर मीडिया तक इस पर गौर ही नहीं कर रहे। मीडिया का समझदार तबका भी इसे ‘बीमार समाज का अपराध बता रहा है, जिसे आरुषि जैसी असुरक्षित लड़कियां झेलती हैं।’ लेकिन साफ बात नहीं कर रहा।

आपको यूं ही बता दूं कि मीडिया जिसे आरुषी लिख रहा है, वह हिंदी में अपना नाम आरुशी लिखा करती थी। ये बात मुझे उसकी स्कूल-कॉपी के दो पन्नों को देखने से पता चली। यह पन्ने जनवरी 2003 के थे, यानी तब आरुशी की उम्र 9 साल से कम थी। इसमें दाल न गलना मुहावरे का जिस तरह वाक्य प्रयोग आरुशी ने किया था, उसे देखकर मेरा माथा चकरा गया। उसने लिखा था – मंजू के कत्ल के बाद भी उसकी दाल न गली। नौ साल को होने को आई एक बच्ची के दिमाग में क्या घूम रहा था कि वह सीधे से मुहावरे के लिए कत्ल जैसे शब्द का इस्तेमाल कर रही है? इसके लिए किसी बाल-मनोवैज्ञानिक के ज्ञान की ज़रूरत नहीं है, बल्कि सामान्य-सा शहरी भी बता सकता है कि आरुषि का बचपन सामान्य नहीं था। कोई ऐसी बात थी जो उसे अंदर ही अंदर खाए जा रही थी। वह छटपटा तो रही थी, लेकिन निकल नहीं पा रही थी।

गौर करें। डॉ. राजेश तलवार सोने से पहले आरुशी के कमरे का दरवाज़ा बाहर से बंद कर देते थे और चाभी अपनी तकिया के नीचे रख लेते थे। डॉ. तलवार अपने नौकरों को बराबर बदलते रहते थे या कहें तो किसी नौकर तो अपने यहां ज्यादा टिकने नहीं देते थे। आरुषी के बालमन की हालत और इन दो तथ्यों को मिलाकर देखें तो इस बात का पर्याप्त इशारा मिल जाता है कि आरुषी 8-9 साल की उम्र में ही घर के किसी न किसी पुरुष नौकर के सेक्सुअल एब्यूज़ का शिकार हुई थी। मां-बाप की व्यस्तता, अंतर्मुखी स्वभाव और बाल-सुलभ कुतूहल के चलते आरुशी को बाद में इस ‘एब्यूज़’ की लत लग गई। इससे बचने के लिए डॉ. दंपति घर के नौकर बदलते रहते थे। उन्होंने आरुषी को मारा-पीटा और समझाया भी होगा। उस दिन जब घर पहुंचने उन्होंने आरुशी के बिस्तर पर हेमराज को देखा तो उनका गुस्सा सातवें आसमान पर पहुंच गया और उन्होंने सर्जिकल चाकू से दोनों का गला रेत दिया।

इस तरह मुझे लगता है कि आरुशी की हत्या के पीछे की असली कहानी हमारे समाज में बच्चों के साथ होनेवाले सेक्सुअल एब्यूज़ और उसको लेकर मां-बाप के अंधेपन की कहानी है। हो सकता है कि राजेश तलवार के अनीता दुर्रानी के साथ नाजायज़ रिश्ते रहे हों, लेकिन उनमें बाधा बनना घर की इकलौती बेटी आरुशी की हत्या की वजह नहीं हो सकती। डॉ. तलवार दंपति अगर वाकई संवेदनशील और समझदार होते तो अपने यहां चौबीस घंटे के पुरुष नौकर के बजाय महिला नौकरानी रखते। साथ ही आरुशी के प्रति निर्मम बनने के बजाय किसी मनोचिकित्सक की मदद लेते। लेकिन क्या कीजिएगा, डॉक्टर दंपति ही नहीं, ज्यादातर मध्यवर्गीय परिवार चाइल्ड एब्यूज़ की समस्या से आंखें मूंदे हुए हैं। इसीलिए मैं कहता हूं कि आरुशी आज भी जिंदा है और वह कहीं न कहीं अपना चौदहवां जन्मदिन भी मना रही होगी। जिस्म अलग होगा, लेकिन अंदर की बेचैनी वही होगी और उससे निकलने की तड़प भी वैसी ही होगी।

आरुशी का कातिल कौन?

आरुशी तलवार हत्याकांड में एक बार फिर सी०बी० आई० के हाथ जांच में निराशा ही लगती दिख रही है। जिस मोबाइल फ़ोन के दम पर खबरिया चैनल जाँच एजेंसियों के हाथ कातिल तक पहुँचने का दावा कर रहे थे वो किसी काम का भी नही निकला। एक तो सोलह महीने बाद किसी फ़ोन से डाटा रिट्रीव कर पाना लगभग नामुनकिन है दूसरे इस फ़ोन में जा एजेंसियों के हाथ असली डाटा कार्ड लगा ही नही। बल्कि जिस रामफूल से ये मोबाइल बरामद किए जाने का दावा किया गया था उस के मुताबिक उसके पास जब यह फ़ोन आया तो उसमे कोई कार्ड लगा ही नही था॥ उस के मुताबिक जब यह फ़ोन उसकी बहन को पाया तो इस फ़ोन में ना सिम कार्ड था और ना ही मेमोरी कार्ड। वो मोबाइल चलाना जानती ही नही सो उस ने बेकार समझ कर ये फ़ोन उसे दिया था, इस उम्मीद में की शायद बाही के किसी काम का हो। फिलहाल तो एक बार फिर इस बहुचर्चित केस की गुत्थी उलझती नज़र आ रही है।
मगर इस समय का सब से बड़ा सवाल ये है की इस केस की गुत्थी उलझती जा रही है या उलझाई जा रही है ? इस सवाल का जवाब पाना आसान नही मगर हालत का इशारा तो यही है के कोई कोई न कोई इस मामले को उलझाए रखना चाहता है। डाक्टर तलवार खबरिया चैनलों पर दावा कर रहे हैं के उनकी बेटी का क़त्ल उनके नौकरों ने ही किया है। हो सकता है उनका दावा सच हो मगर जिस तरह इस हाई प्रोफाइल मामले में लगातार सबूतों से छेड़खानी और पुलिस का दोहरा चेहरा सामने आ रहा है उसे देखकर तो उनके दावे पर यकीन मुश्किल हो जाता है। फ़िर सवाल ये भी है के उनके नौकर हेमराज का कातिल कौन है और उसका आरुशी के क़त्ल से क्या वास्ता?

इस बात पर यकीन कर पाना मुश्किल है के लो प्रोफाइल नौकर जांच एजेंसियों को इतने दिन तक गुमराह कर सकते हैं। अभी तक आरोपी बनाए गए लोगों में ख़ुद डाक्टर तलवार को छोड़ कर किसी और की इतनी हैसियत नही है की वो किसी तरह की जोड़ तोड़ कर सबूतों की अदला बदली करा दे। ख़ास कर जैसे फोरेंसिक जांच के लिए भेजे गए आरूषी के D.N.A सैम्पल के साथ छेड़खानी की बात सामने आई है उसे कोई लो प्रोफाइल आदमी अंजाम दे ही नही सकता।

जिस तरह आम आदमी से पुलिस का अदना सा सिपाही पेश आता उसे देखकर तो कोई यकीन कर ही नही सकता के दो चार मामूली नौकर मिलकर बार बार जांच का रुख बदल सकते हैं। जिस रामफूल से मोबाइल मिला है वो भी कोई तुर्रम खान नही है। उसकी बहन घरो में बर्तन साफ़ करती है तो वो ख़ुद एक चपरासी है।

फिलहाल जो हालत हैं उनका इशारा है के जाच के लिए हाथ पैर मार रही एजेंसियां तब तक कामयाब नही होंगी जब तक छेड़खानी करने वालो के साथ सख्ती से पेश नही आती।
इतना भी तय है के आरूषी के क़त्ल का सुराग नॉएडा के जलवायु विहार की उसी चार दिवारी में क़ैद है जिसमे उस ने आखिरी साँस ली। उस के बाहर खुक्च ढूंढ़ना ख़ुद पुलिस और जांच एजेंसियों पर सवालिया निशाँ लगाता रहेगा।

Update on the Aarushi Talwar trial.

The CBI today told a special court that Rajesh and Nupur Talwar killed their daughter Aarushi and domestic help Hemraj in a fit of rage after finding them in a compromising position, a claim strongly refuted by the dentist couple.


The Talwars contested CBI's claim, saying that sex is no big deal in elite society and does not entail murders. Resuming its argument on framing of charges in the May 2008 twin murder case, CBI counsel R K Saini told Special Judge Shyam Lal that on the fateful day Talwars had returned home late in the evening and not finding Aarushi and Hemraj in the living room went to their daughter's room.


Saini said the room was locked from inside but Talwars opened it from outside with another key and found their daughter and Hemraj in a compromising position and got infuriated.


An angry Talwar picked up a golf stick and repeatedly hit Hemraj and his daughter with it, Saini said. As the two fell unconscious, Talwars slit their throat
with a surgical blade, a work done with the precision expected of experts like them, he said.

Nupur, however, personally, dismissed the charge saying that they belong to elite class of society where one does not kill anyone for indulging in such sexual acts. She added that they dearly loved their daughter and there was no question of killing her even after finding her in a compromising position as the matter could have been resolved.
